Case Brief
While conducting overseas trademark monitoring for a renowned domestic automobile enterprise under its mandate, we discovered a registered domain name in Chile that contained the trademark letters of said automobile brand. Furthermore, the industry associated with this domain name was also within the automotive sector, potentially constituting a rights conflict with the automobile enterprise's trademark registration in Chile.
After obtaining authorization from the client, WEIPR filed an application for revocation with the Chilean domain name dispute resolution authority and subsequently initiated arbitration proceedings with the Chilean arbitration authority. The arbitrator of the Chilean domain name arbitration authority accepted our revocation request and transferred the disputed Chilean domain name to our client.
Case Review
Trademark infringement manifests in various forms, with the preemptive registration of trademarks and domain names being a common one. Once successfully registered, infringers may cloak their infringing activities in legality. In addition to conventional domestic and international trademark similarity monitoring, our company also provides domain name monitoring services. Through these services, we detected the registration of similar domain names by others and successfully assisted our clients in safeguarding their rights.
