The applicant of the trademark “中国信科” is China Information and Communication Technology Group (short as CICT), which is the birthplace of China’s optical communication, and one of the main proposers of international standards for mobile communication with its own core intellectual property rights, as well as an internationally renowned provider of information and communication products and comprehensive solutions. In January 2019, CICT applied for the trademark registration of “中国信科”. However, it was rejected by Trademark Office for the examiner determined that the trademark registration violated Article 10(1) of the Trademark Law.
On receiving the notice of rejection, WEIPR, the entrusted agent, immediately started a comprehensive search for relevant cases and academic literature. After in-depth analysis of the rejection documents and detailed provisions of Trademark Law, WEIPR summarized a large amount of evidence to prove that the trademark “中国信科” and its applicant CICT formed a one-to-one and correspondence, which was significant and the public would not be confused or misled. In addition, other similar cases being approved for registration were listed to request the Trademark Office reexamine the applied trademark in accordance with consistency principle.
In April 2020, WEIPR received the decision on the reexamination of trademark “中国信科”, which said that the trademark application was approved preliminarily. On hearing the notice, WEIPR continually guided the applicant to supplement the registration of “中国信科” in other classifications. As of October 2021, after more than two years, CICT Group complete its trademark layout of “中国信科”.
