“Ding Nai” pepper powder is a renowned pepper brand in Hubei Province, occupying a market share of over 60%. Since the 1990s, it has been repeatedly awarded as a “Famous Trademark of Hubei Province” and a “Famous Trademark of Wuhan”, boasting a high level of popularity and reputation.
In October 2019, the pepper powder similar to the “Ding Nai” brand began selling on the market, adopting a packaging design resembling “Ding Nai” pepper powder. Upon learning that the seller of the similar trademark belonged to another condiment company in Wuhan, the responsible person of “Ding Nai” pepper powder entrusted WEIPR to file an invalid declaration request against the imitative trademark.
After receiving the entrustment, WEIPR assisted the client in organizing materials used and for promotion in over 20 years to prove the popularity of the cited trademark “Ding Nai”. At the same time, WEIPR actively collected evidence from sales platforms such as Taobao and JD.com and discovered that the opposing party had promoted their product under the name of “Ding Nai”, further demonstrating their clear malicious intent. Additionally, WEIPR conducted an investigation and analysis of the trademark squatter, discovering that they had not only imitated the client’s trademark but also copied other well-known pepper brand trademarks in Wuhan. This evidence further proved their malicious disruption of the market competition order and their intention to squat on famous brands.
Ultimately, our firm successfully invalidated the imitative trademark. To prevent further malicious imitation, WEIPR recommended that the client establish a trademark defense system.
