Since the start of 2026, Indonesia has rolled out a series of new intellectual property regulations spanning official fee adjustments, patent prosecution, trademark registration, and online infringement enforcement. Among these, the government regulation that raises trademark official fees by roughly 50% overall and takes effect on 1 August 2026 has the most direct impact on Chinese businesses expanding into the Southeast Asian market.
Trademark Official Fees Undergo Substantial Revision, with Increases of up to 57%
On 2 July 2026, Indonesian President Prabowo Subianto signed and promulgated Government Regulation No. 30 of 2026 (PP 30/2026), which comprehensively revises the non-tax state revenue (PNBP) rates applied by the Directorate General of Intellectual Property (DJKI) under the Ministry of Law and Human Rights, replacing the previous Regulation No. 45 of 2024. The new regulation will take effect on 1 August 2026.
In an official statement, the Director General of DJKI noted that this adjustment represents the largest increase in trademark official fees in recent years and is aimed at keeping pace with technological developments, the growth in application volumes, and the need to enhance the quality of public services.
The trademark fee schedule undergoes the most dramatic changes in this round, covering the entire lifecycle from filing to maintenance. The table below sets out the revised rates for key items:

Special note: Micro, small and medium-sized enterprises (UMK) remain eligible for the reduced rate (trademark application IDR 500,000 per class unchanged). However, this concession is available only to UMK registered locally in Indonesia. For patent, basic filing fees and annuities remain unchanged, but PP 30/2026 introduces several procedural fees, including: early substantive examination (accelerated examination) at IDR 15,000,000, substantive re-examination at IDR 5,000,000 , extension of the priority period at IDR 5,000,000, and graduated fees for the resumption of examination following withdrawal in various scenarios.
For copyright, the registration fee for songs and musical works has been reduced from IDR 200,000 to free. The Director General of DJKI stated that, out of approximately 7 million musical works circulating in Indonesia, only around 26,000 (0.37%) have been formally registered. The fee waiver aims to encourage creators to register their works and to build a comprehensive national music database. Registration fees for other categories of copyright works remain unchanged.
The official fee for geographical indications has been adjusted from IDR 450,000 to IDR 1,450,000. While this appears to be a more than threefold increase, it in effect consolidates the previously separate substantive examination fee (IDR 1,000,000) into a single upfront payment, so the total cost remains the same.
Accelerated Trademark Registration Procedures
The new trademark registration regulation that came into force on 23 February this year introduces several procedural optimisations:
· Shortened substantive examination timeframe: Where no opposition is filed, substantive examination must be completed within 30 business days; where an opposition is filed, it must be completed within 90 business days (previously the period could extend to as long as 150 days).
· Faster renewal processing: The recordal of a trademark renewal has been reduced from two months to four business days.
· Quicker issuance of official certified excerpts: The time limit for issuing official certified excerpts has been shortened from 15 business days to one business day.
· New force majeure provision: In circumstances such as war, natural disasters, riots, strikes, etc., applicants may apply for an extension of administrative deadlines.
· New documentary requirements: Legal entity applicants must submit their deed of establishment that has been notarised and accompanied by a sworn translation; priority documents must also be accompanied by a sworn translation.
· Pending trademarks now assignable: The right to a trademark application may now be transferred during the examination phase, providing flexibility for trademark portfolio management in the context of M&A and corporate restructuring.
New Framework for Patent Applications
The new patent application regulation, which came into force on the same day as the trademark registration regulation, implements the procedural provisions of the 2024 Patent Law amendment:
· Expanded scope of patentable subject matter: The definition of an “invention” now expressly encompasses systems, methods, and uses, opening broader protection avenues for software and digital technology innovations.
· Excess claim fees payable at filing: Additional fees for claims exceeding 10 can no longer be deferred to the substantive examination stage; they must be paid at the time of filing. Failure to pay may cause the application to be deemed withdrawn.
· Fully electronic filing: All patent applications must be submitted through the DJKI online system; paper filings will no longer be accepted.
· Introduction of expedited publication: Applicants may request expedited publication as early as three months after the filing date (not applicable to applications claiming priority).
· Introduction of early substantive examination: A request for early substantive examination may be filed after completion of the administrative requirements and before publication. The examination decision must be issued within 12 months after the end of the publication period.
· New substantive re-examination procedure: A request for substantive re-examination may be filed in cases where an application has been refused, requires correction after grant, or has been withdrawn or deemed withdrawn, providing applicants with an additional avenue of administrative remedy.
Expanded Online IP Enforcement
A new ministerial regulation on online infringement handling, effective December 2025, establishes a cross-agency enforcement mechanism:
· Substantially broadened scope of protection: The scope extends from the 2015 joint regulation that covered only copyright and related rights to now encompass all categories of IP rights, including patents, trademarks, industrial designs, trade secrets, geographical indications, layout-designs of integrated circuits, and communal intellectual property.
· Complaint – verification – enforcement closed loop: Rights holders may submit infringement reports online through the DJKI website or in writing offline. Upon passing administrative review, a joint verification team comprising representatives from the Ministry of Law and Human Rights, the Ministry of Communication and Digital Affairs, and IP industry associations conducts verification within three business days (24 hours for live-streaming infringement) and may recommend measures such as partial takedown, complete takedown, or access blocking.
· Accompanying fee schedule: PP 30/2026 simultaneously introduces official fee rates for takedown requests and mediation services.
