The INPI has revoked Ordinance No. 26/2024 (dated December 23, 2024) and introduced Ordinance No. 03/2025, effective April 1, 2025. This ordinance outlines revised criteria for accepting Phase V applications under the Patent Prosecution Highway (PPH) Pilot Project. Following are the key updates:
1. Annual and Quarterly PPH Application Quotas
Annual Limit: A total of 3,200 PPH applications will be accepted in 2025.
Quarterly Allocation: Starting April 1, 2025, 800 applications will be made available quarterly (April 1, July 1, and October 1). Applications will be processed based on the date and time of submission.
2. Special Quota for IPC H04 Patents
In the second quarter of 2025, 140 PPH applications will be reserved for patent applications classified under IPC H04 (International Patent Classification). Additional classifications may be reviewed quarterly.
The INPI will publish weekly updates on the number of PPH applications received in 2025 via its official website under the Patents – Patent Prosecution Highway (PPH/GPPH) – Statistics section.
It’s worth noting that rejected PPH applications due to quota limits will retain regular processing status, and amendments submitted with such applications will not be considered. Moreover, Applicants may request refunds for rejected PPH applications or reapply with new documentation.
