On November 15, 2024, U.S. Patent and Trademark Office (USPTO) announced updated trademark fees in a final rule, effective January 18, 2025.
The proposal for updated trademark fees was shaped by public feedback beginning with a public hearing in June 2023 hosted by the Trademark Public Advisory Committee (TPAC). Following the hearing, TPAC provided a written report detailing the public comments received and its recommendations regarding the proposed fees. All comments, advice, and recommendations were considered and analyzed, and on March 26, 2024, a Notice of Proposed Rulemaking on setting and adjusting trademark fees was published. Again, additional comments were invited and considered and responses to these comments are included in the final rule.
This final rule sets or adjusts 28 trademark fees, which involve some important and inevitable fees and show a significant increase. Some of those changes are highlighted below.
l Application fees
This final rule replaces the two types of application fees—Trademark Electronic Application System (TEAS) Plus and TEAS Standard—with one base application fee for applications under Trademark Act sections 1 and 44. Customers will also see new surcharges based on the complexity and completeness of their application.

Amendment to allege use (AAU) and statement of use (SOU) fees haven’t been adjusted since 2002, even as processing costs increased during the subsequent two decades. However, as the examination time for these filings has also increased due to the volume of questionable specimens received by USPTO, the two fees are increased correspondently.
